I should add that being in gen ed this much, you're now requiring gen ed teachers to become sped teachers as well. We still love these students, want them to be included some, and be successful.
Good video. The problem is, schools are not taking LRE as keep them in gen ed except 20 minutes once or twice a day when they're receiving nothing, or almost nothing in the gen ed room. Another issue is a child with BD. They are throwing furniture, breaking items, cursing, and disrupting the classroom for 10-60 minutes at a time. The other students are scared daily. The teacher is supposed to keep teaching and ignore. The sped teacher, principle, BD specialist and sometimes 1 or 2 others along with the para are all attending to this 1 student and trying to get them out of the room. They already have ALL the supports in place... visuals, schedule, rewards, terminology, penny board, breaks, you name it. It goes on day after day. Students are traumatized and teachers have literally received a PTSD diagnosis from having a student like this in their classroom day after day. Then the other issue is, with there being only 1 sped teacher in our building, then the other students aren't receiving their legally required daily minutes when the sped teacher is attending to this BD child. Feds need to make LRE MORE CLEAR!!! This is NOT fair to the gen ed students and frankly not the teachers that have this child each year either. Then people wonder why paras and teachers are leaving education.
What if the person is an adult over 21 is there any free services and free special education that they can receive I have a friend who’s deaf she has no education. She’s come from another country when she was 25 years old so she wasn’t eligible for the IEP And they threw her right into work but it’s hard labor and she’s having back pains and she really needs an education. She needs an education in ASL because she can sign but she never had formal education in ASL and she needs an education in school so that she can get a decent job and a desk job, I feel like she’s been classified
I certainly enjoyed the difference on views in this video. While Jennifer slightly discourages, and warns parents about the risk to due process; Julie on the other hand, supports due process if parents are absolutely sure that they need it. Very informative video! Thanks to both of you!
Instead of the R-word, do you want to say "latent developing",? I believe that is what it means in linguistic terms, as it derives from Latin which is where many medical/scientific terms are first created. While we're at it, can we stop referring to high-functioning autism as "Aspergers/aspie". The German Dr. Asperger brought it to the attention of the Nazi's (who were gassing any individuals with intellectual disabilities at the time). Not exactly to be remembered as an advocate, he only saved the lives of some boys to be of use for the Third Reich.
I enjoyed watching this episode. I do have a question. My question is, is there a Grade-wise switch that pre-K-12 is IDEA and then once in college, it switches to the 504 plan? I am curious.

Does it mean that diagnosis is part of the assessments before the eligibility evaluation?
This helped me understand the meaning of FAPE when it was referenced by a candidate for the school district I live in. And I have family and friends who have kids who needed some support.

I'm having to watch the videos here for my Bachelor's, but I'm noticing there is a repetativeness to some of what is said....
There's only so much they can work with, especially since all of these disability videos go back to the same message(s) for the parents and educators watching. Also this was uploaded 9 years ago so I'm sure they found new information.

My son needs audiological services or at the very least audiological consultation between the LEA in order to address hyperacusis, but it has been refused up until this point. It keeps being lumped in with sensory issues, which we have a medical diagnosis stating that he also has hearing impairments, 4 different diagnoses, that qualify him as such. He continues to struggle because they refuse to acknowledge them as separate. I was hoping to find answers here, yet, still find none. I find nothing anywhere about this, and many kids are falling through the cracks and having to wear headphones that only increase sound sensitivity, and possibly, were aggravated from what may have been a low tolerance to a severe one due to the school taking it upon themselves to equip him with headphones on a constant basis, unbeknownst to us.
Suffered this in high school and failed my exams, still suffers anxiety too.. Sad how people ignore it!
What if the school changed a students disability accomodation without prior written notice of any kind? My sutistic son requested access to a quiet classroom so that he could de-escalate from an anxiety attack. The ese teacher told him "what you want doesn't matter. The new schoolwide rule is you go to the guidance dept waiting room and wait to talk to your guidance counselor.
What is the role of an advocate at an IEP meeting ? My child's school said the advocate can't speak to the IEP panel but only be there to advocate and support me and hear but not speak to the panel. Do you have a video or information or policy on this?
That is incorrect. The advocate is invited as a member of the team as they have a special interest in the child.
The R-Word is highly inappropriate and very offensive to children and adults with intellectual disabilities and should be removed from all sources.
History is part of the lesson, it is good to remember where we came from as a society to not repeat the missteps. ----The term “mental retardation” has been largely replaced by “intellectual disability” in many areas, including federal education, health, and labor statutes. This change was brought about by Rosa’s Law, signed by President Barack Obama in 2010. However, as of 2013, there were still some states that used the term “mental retardation” in official documents. These states included Colorado, Indiana, Louisiana, and Oklahoma. Please note that this information might have changed after 2013, and it would be best to check the current regulations or terminology used in these states. I hope this helps.
question is this for a MET only or a IEP and 504?

I have specific learning disabilities,and I'm happy with it..I still got my diploma early. Reading a lot ,doing math,and writing is often my favorites. Yes I have an IEP.🤗 Thank you for sharing this too.

This video did nothing in furthering my understanding of Hearing Impaired. It basically tells me the textbook definition, and then spoke more about the meaning of category eligibility.
I dunno if you had watched the others, but I notice after this textbook style definition, they repeat a lot of what they are saying on the videos. It's unusual...

How could I find an advocate in CT? CPAC has on several occasions told me nearly word for word the same thing and won’t give me even an appointment to talk to someone.
Is there anything further on this? I’ve spent three years asking for a meeting and at every PPT the administrator stops the meeting when I ask about my sons future placements and options. I finally snapped and yelled throughout the last one until the head of family services popped on, said we should end the meeting and then I demanded to meet just then which we did. And at which she acknowledged that I had requested a meeting over 60 days prior. She warned me that all other programs are dismal and educationally, before setting our next PPT date.
How can you prove they have lied to fudge numbers or scores to make your child ineligible to save money? I have past and present teacher friends who say this happens and the teachers are powerless and basically told to sit and shut up at eval meetings
Great video, you ladies did an excellent job of breaking down the 13 different disabilities that are under the IDEA act. I am at grad school studying English Literature, secondary education and this material is helping, with reinforcing the information in the textbook. Now some people get confused between a disorder and a disability. For example, I was diagnosed with attention deficit disorder or ADD not ADHD in the 80s. I was mainstreamed in the 7th grade but from the 1st through 6th grade, I was in Special Education. Diagnosis is from a medical professional and that is what you are going to be diagnosed it, for example Autism or specific learning disability like dyslexia. Just because you have the diagnosis does not mean you are eligible. Eligibility is resource driven and determines if someone qualifies for services and/or accommodations. A student must have a disability and show a need for services that cannot be addressed through general classroom instruction. School’s do not provide a diagnosis; through an evaluation they determine eligibility for special education services. We have come a long way because back in the darker days, they did not have IEP or individualized education plans for students with special needs or the resources we have today. When I was a freshman in high school, it was a big deal that our school had internet in the library. With all of the technological tools, students now have key advantages. So back to my disorder that is technically under the 13 disabilities, but it is not a disability because technically ADD does not meet specific Learning Disability definition. What is an example Dyslexia or math calculation they have a special word for it. ADD causes you to sometimes have a lack of focus or pay attention, which can be a hinderance to learning but it is not a learning disability per se yet it is covered. Parents often get caught up in if their child is eligible for example they have dyslexia, what speech software are they eligible for, they should go a different route. Focus on the Individualized Education plan and a good teacher should have a unique plan, for your student. If that includes a speech program to help, then it will be included, that is what the Federal Law was intended for. It was intended to give students with one of the 13 disabilities, accommodations and an IEP. States can add to the Federal definitions a bit, but they can't take away those two key components, accommodations and Individualized Education Plan or IEP. Parents of students with a disability I will give this advice. My parents came here from Germany and Russia, so they did not know the law. My teacher was lazy and recommended Special Education, when in reality I should not have been in it. By law a teacher has to consult with an M.D and that M.D has the final say. If the Psychiatrist or Neurologist recommends your child be put in Special Education, THEN ACCEPT it. Do not accept the teacher's word for face value because there are some bad and lazy educators. Also, I will say this I am Caucasian and I want to speak to black parents out there. The black student population does not represent the teacher population over 80% of the teachers are from the mainstream Caucasian culture. Most are good but some might be prejudice and just not wnat to deal with your kid because they are black so they might say, "oh your child has ADD i recommend special education." Be sure to talk to a Psychiatrist first and have them run your kid through a series of tests before you sign off on that.

so due process uses "Fair" let's say a parent wants to file a suit and acts as a pro se litigant, is it "UNFAIR" PROCESS if the parent doesn't know the laws, procedures, etc and asks for additional time to get proficient to have a "FAIR" ADVANTAGE?

Think of School District as you allies. We won't work for school districts for such low salaries if didn't love/care for our school kids.
